Waiver of Liability:
By booking transportation services with Waggin Taxi, you agree to the following waiver of
Liability:
1. Assumption of Risk:
By booking transportation services with Waggin Taxi, you expressly acknowledge, understand, and agree to the following comprehensive waiver of liability and assumption of risk. You fully assume all risks associated with the transportation of your pet, including but not limited to:
a. Injury or death occurring during loading, unloading, or transit.
b. Stress, anxiety, or medical complications resulting from travel.
c. Accidents, vehicle malfunctions, or unforeseeable incidents during transport.
You understand and acknowledge that the transportation of your pet involves certain inherent risks, including but not limited to, injury during loading/unloading, travel-related stress, or accidents. You agree to assume all risks associated with the transport of your pet and accept full responsibility for your pet’s well-being while in transit. You voluntarily agree that Waggin Taxi bears no responsibility for any injury, harm, distress, or fatality suffered by your pet while in transit.
2. Complete Waiver of Liability: To the fullest extent permitted by law, you expressly waive, release, and forever discharge Waggin Taxi, its owners, employees, agents, affiliates, contractors, and drivers from any and all liability, claims, demands, or causes of action arising from or relating to:
a. Cause. Any injury, illness, death, or distress suffered by your pet during transportation, regardless of
b. Any damages or losses, including but not limited to veterinary expenses, emergency care costs, or replacement costs associated with injury or loss of your pet.
c. Any third-party claims resulting from your pet’s behavior, condition, or actions during transit.
You acknowledge and agree that Waggin Taxi is not responsible for any unforeseen medical issues, injuries, or loss even if caused by the negligence of Waggin Taxi, its employees, or affiliates.
3. Indemnification & Legal Defense: You agree to fully indemnify, defend, and hold harmless Waggin Taxi, its owners, drivers, employees, contractors, and affiliates against any and all claims, lawsuits, losses, liabilities, damages, or expenses, including attorney fees and court costs, arising
From:
a. Your pet’s behavior, condition, or actions during transportation.
b. Injuries or damages caused by your pet to persons, property, or other animals during the trip.
c. Any misrepresentation or failure to disclose medical conditions affecting your pet.
d. Any breach of this agreement by you or your representatives.
This indemnification applies whether or not litigation is initiated, and you agree to cover all legal costs associated with defending Waggin Taxi against any claim related to your pet’s
Transportation.
4. Emergency Medical Decisions & Costs: If a medical emergency arises at any time during transport, Waggin Taxi will make reasonable efforts to contact the owner or designated representative. However, if the owner cannot be reached, you:
a. Authorize Waggin Taxi to take all necessary actions to protect your pet’s well-being, including but not limited to emergency veterinary care.
b. Agree to bear full financial responsibility for all costs incurred for such emergency care, including veterinary expenses, medications, and hospitalization.
c. Waive all claims against Waggin Taxi regarding the necessity, appropriateness, or outcome of such emergency care.
You acknowledge that Waggin Taxi is not a licensed veterinary service and makes no guarantees regarding medical outcomes.
5. No Refunds & Binding Agreement: All fees paid for transportation are non-refundable, including in cases of delays, cancellations, or unforeseen circumstances beyond Waggin Taxi’s control. This waiver and indemnification agreement is legally binding upon booking and extends to all future bookings unless explicitly revoked in writing by Waggin Taxi.
By booking transportation services with Waggin Taxi, you affirmatively acknowledge and accept these terms, assuming full legal responsibility and waiving all rights to claim damages against Waggin Taxi for any reason whatsoever.
1. Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to this agreement, the services provided by Waggin Taxi, or any other matter related to pet transportation, including but not limited to claims of breach of contract, negligence, misrepresentation, or violation of any statute or regulation, shall be resolved exclusively through binding arbitration.
a. The arbitration shall be conducted in Passaic County, New Jersey, in accordance with the rules and procedures of the American Arbitration Association (AAA).
b. The arbitration shall be presided over by a single arbitrator selected by mutual agreement of the parties or, if the parties cannot agree, appointed pursuant to AAA rules.
c.The arbitrator shall have exclusive authority to determine the enforceability of this arbitration provision, including any objections with respect to jurisdiction or validity.
d. Each party shall bear its own attorney fees, costs, and expenses, except as otherwise awarded by the arbitrator.
The parties waive the right to a jury trial and agree that arbitration shall be the sole and exclusive method for resolving disputes arising under this agreement.
2. Class Action Waiver: The parties agree that all claims must be brought in an individual capacity, and not as a plaintiff or member of a class action, collective action, or representative proceeding. The arbitrator shall not have the authority to consolidate claims or hear cases as a class action.
3. Governing Law & Jurisdiction: This agreement shall be governed by and construed exclusively in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.
a. Any legal action seeking to challenge or enforce an arbitration award, or any claim that is not subject to arbitration under this agreement, shall be filed exclusively in the state or federal courts located in Passaic County, New Jersey.
b. The parties irrevocably submit to the exclusive jurisdiction and venue of these courts and waive any objection to jurisdiction, venue, or the doctrine of forum non conveniens.
c. Waiver of Jury Trial: To the fullest extent permitted by law, the parties knowingly and voluntarily waive their right to a jury trial in any legal proceeding related to this agreement.

By booking transportation services with Waggin Taxi,, I acknowledge that I have read, understood, and agree to the terms, conditions, and policies outlined in this agreement, including but not limited to the Waiver of Liability, Indemnification, Arbitration Clause, and Jurisdiction Clause.
I understand that by booking transportation services with Waggin Taxi, I am legally bound by this agreement.
I further acknowledge that I am the legal owner or authorized representative of the pet being transported and that I assume full responsibility for compliance with this agreement.
